An analysis by the Assoprovider Study Center on regulatory differences between Italy and the European Union
The Assoprovider Study Center has published the first in a series of reports dedicated to comparing Italian regulations with those of other European Union countries, with particular attention to the impacts on local operators.
This first in-depth analysis concerns the AGCOM Resolution no. 156/23/CONS, which regulates the quality and transparency of Internet access services. Italian regulations require all operators - without exceptions - to use the official platform MisuraInternet of the Fondazione Ugo Bordoni, with direct costs borne by them.
What does the resolution provide?
- Certified measurements of the performance offered to customers.
- Exclusive use of the MisuraInternet FUB platform.
- Membership and management costs for operators.
- Obligation to communicate results to customers and comply with contractual parameters.
- No exemption for small proximity providers.
The European comparison
Our study shows that Italy is the only EU country to impose a mandatory platform for a fee. In other Member States, when available, the platform is free or optional, with simplified regimes for local operators.
This difference creates a competitive disadvantage for Italian operators compared to their European counterparts, imposing an additional onerous requirement within a regulatory framework that already includes 23 specific obligations, including Piracy Shield e ACN.
Next steps
The report is the first in a series that will analyze other Italian regulations in comparison with EU ones. The objective is to lay the groundwork to highlight, in the appropriate venues, the disparities that limit the competitiveness of Italian operators. Once approved, the Digital Networks Act – scheduled for December 31, 2025 – these differences may become subject to review and harmonization at the European level.
